The Protecting Americans from Tax Hikes Act of 2015 passed by Congress in December renewed the popular charitable IRA provision allowing those aged 70 1/2 or older to make direct charitable gifts from traditional and Roth IRAs to qualified charities up to $100,000 free from federal income taxation.
Could you benefit?
Making gifts from IRA funds that would otherwise lead to increased taxes can be a wise choice for many. This is especially true for those who must take required minimum distributions each year.
- He or she is at least 70 1/2 years old on the date of the gift.
- The distribution is made from a Traditional or Roth IRA. Distributions from 401(k), 403(b), SEP, and SIMPLE accounts are not permitted.
- The distribution must be made to a tax exempt organization classified as a public charity, like Smoky Hills Public Television. Gifts to supporting organizations are not permitted. It’s not uncommon for foundations and “friends groups” to be classified as supporting organizations. Verify your station’s charitable status before promoting this opportunity.
- The gift must be made directly from the IRA administrator to the station. In other words, the donor can not receive the distribution and then make a gift of the funds.
